Walmart updated its terms and conditions this week to make sure that when its AI shopping agent makes a mistake, you pay for it.
Walmart built the tool. Walmart deployed the tool. Walmart profits from the tool. And Walmart’s legal team has now made sure that when the tool gets your order wrong, the liability travels to you.
That is not a policy update. That is a confession that the tool was not ready for the responsibility it was handed.
This is where agentic AI stands today. Not in the future. Today.
The Agent Acts. You Pay.
Agentic AI systems are autonomous. They research. They select. They purchase. They act on your behalf without asking again once you hand them the keys. That is the selling point. That is also the problem.
An independent researcher who has personally tested these systems puts the current success rate at roughly 70 percent. That means three in ten agentic transactions produce an error. A wrong item. An out of stock purchase. A shipping failure. A multi-week delay. At the scale these systems are being deployed, that is not a glitch rate. That is a structural failure rate dressed up in marketing language.
Retailers know this. That is why the legal language is moving faster than the technology. The terms and conditions are being rewritten now, before the wave of consumer complaints arrives, because the people building these systems understand exactly what is coming.
One retail executive said it plainly. Policy is now part of the product.
He is right. But the policy being written right now is not designed to protect you. It is designed to protect the retailer from you.
The Human Is Still On the Hook
Here is what none of the press releases say out loud.
When an AI agent acts, the human attached to it owns the consequence. The agent executes. The human absorbs the error. The retailer points to the disclaimer buried in the updated terms you did not read because no one reads them.
This arrangement has a name. It is called unilateral risk transfer. The retailer takes the efficiency gain. The consumer takes the downside. The AI sits in the middle collecting neither accountability nor consequence because it is not a legal entity and was never designed to carry either one.
One marketing officer quoted in the retail industry press this week said something that should be printed and posted in every boardroom deploying agentic systems right now.
To a consumer, the AI is the retailer.
Not legally. Not on paper. But in the lived experience of the person whose order arrived wrong, whose budget was exceeded, whose return is now caught in a system that did not anticipate the mistake it caused — that person does not experience a legal technicality. They experience a broken relationship with a brand they trusted.
The disclaimer does not fix that. It accelerates it.
What Governance Looks Like Before the Agent Acts

None of the agentic shopping systems currently being deployed contain anything resembling that gate. The terms and conditions being rewritten right now are the industry’s substitute for it. A legal document that protects the retailer is not a governance layer that protects the user. Those are opposite things pointed in opposite directions.
The Wild West Has a Body Count
One technology advisor called the current state of agentic commerce the wild west. He meant it as color. He was more accurate than he knew.
The wild west had consequences. People got hurt. Property was taken. Trust collapsed in institutions that could not enforce the standards they claimed to hold. Order arrived eventually but it arrived after the damage was already done and after enough people had absorbed enough loss that the cost of inaction finally exceeded the cost of governance.
That sequence is running again. The scale is different. The speed is different. The damage accumulates faster because the systems scale faster. But the shape of the problem is identical.
Retailers rushed to announce AI capabilities. Many are now struggling to make those capabilities work reliably across fragmented data systems and inconsistent product catalogs. The marketing promised a seamless experience. The technology is delivering a 70 percent success rate. The gap between those two numbers is where the consumer lives right now.
Only 13 percent of consumers surveyed said they are very likely to purchase based solely on AI recommendations. Nearly half expressed concerns about accuracy and data privacy. Thirty-six percent have already returned products because of inaccurate information provided during their digital shopping experience.
Those numbers are not a warning. They are a current reading. The public is already telling the industry what it thinks of the governance gap. The industry is responding with updated terms and conditions.
That is the wrong answer delivered confidently.
What Comes Next
The EU AI Act reaches full applicability on August 2, 2026. Eighty-six days. Agentic systems operating in consumer commerce are not exempt from that framework. The liability question that retailers are currently trying to paper over with legal language is about to encounter a regulatory structure that does not care about their disclaimers.
The brands that survive this transition will not be the ones with the most aggressive liability waivers. They will be the ones that quietly reduced the risk rather than loudly disclaimed it. The ones that built governance into the agent before deployment rather than into the terms and conditions after the first wave of complaints.
